Contractual Terms

Summary of the main contract terms
  1. Contract Expiry
    The renter agrees to return the rented vessel in the same condition it was received, assuming the costs for any potential damages.

     

  2. Boat Captain (Skipper)
    The renter declares themselves responsible for the operation of the vessel and agrees not to transfer it to third parties without authorization.

     

  3. Equipment
    The vessel is provided with all necessary accessories and the renter must return it with the same equipment and in the same condition as received.

     

  4. Delivery and Return of the Vessel
    The rental starts and ends at the established times, with a brief explanation on the use of the vessel. Delay incurs an additional cost.

     

  5. Use of the Vessel
    The renter must use the vessel diligently, complying with regulations and navigating under safe conditions.

     

  6. Ownership of the Leased Property
    The renter must keep a copy of the contract on board and show the document to competent authorities if requested.

     

  7. Repairs
    The renter must report any malfunctions and not make modifications to the vessel.

     

  8. Liability
    The renter is responsible for damages to the vessel during the rental period, while the lessor is not liable for damages or penalties due to improper use of the vessel.

     

  9. Charges for Assistance, Salvage, and Recovery
    The customer is responsible for costs related to recovery, towing, salvage, and assistance operations of the vessel only if such services are required due to their negligence or error in using the vessel.

     

  10. Contract Termination
    The contract can be terminated early in case of inappropriate use of the vessel.

     

  11. Governing Law
    The contract is governed by Italian law and both parties must comply with it.

     

  12. Personal Data Processing
    The renter authorizes the processing of their personal data and agrees to communicate any changes.

     

  13. Jurisdiction
    For disputes related to the contract, the Court of Lecce will have jurisdiction.

     

  14. Vessel GPS Monitoring
    The renter is informed that the vessel is equipped with a geolocation system for security and crime prevention purposes, with data retention for five years.

Navigation Norms

It is strictly forbidden to navigate within 200 meters of the rocky coast and within 300 meters of the sandy coast.

Near the bathing establishments there are red buoys 100m away from the coast, take the position of the red buoys as a reference to define the minimum distance.
 

The protected marine area of Porto Cesareo, as shown in the map below, is divided into three zones.
Navigation rules change depending on the area, in particular:

In ZONE “A” (integral reserve) the following applies:​

  • Prohibition of navigation, access and parking of any vessel

  • Navigation speed limited to 10 knots at a distance of less than 1000 meters from the border of the protected area (identifiable by two large yellow buoys)

 

In ZONE “B” (general reserve) the following applies:

  • Anchoring ban

  • Sailing at a speed of less than 10 knots

In ZONE “C” (partial reserve) the following are permitted:

  • Anchoring

  • Navigation without maximum speed limit

Cancellation Terms

If the client, without justified reason or any notice, does not show up for the event on the agreed date, we reserve the right to retain the deposit already paid and additionally request the balance of the full agreed amount.

Beyond a fifteen-minute delay from the agreed time, in the absence of timely notice, the right to rent and the deposit possibly left as a reservation are forfeited.

Any additional services paid for at the time of booking will still be refunded regardless of when the cancellation is made.

If the client needs to cancel a reservation, the following terms apply:
 

  • Standard

    • ​At least 10 days before check-in: 80% refund of the booking amount.

    • Between 10 and 5 days before check-in: 50% refund of the booking amount.

    • Less than 5 days before check-in: no refund.
       

  • Weather conditions

    • ​If weather conditions do not allow navigation on the day scheduled for rental, the client may decide together with Enjoy Salento to postpone the rental.

    • Otherwise, and only if the rental period is one day or less, provided that Enjoy Salento is informed in writing no later than the day before the rental, the client will be refunded the total amount of the booking.
